1. Introduction

The general terms and conditions of sale detailed below only govern the contractual relationship between the User (hereafter referred to as You) and the trader Pixmania (hereafter referred to as We) belonging to the company Fotovista S.A.S. with a capital of 19,033,875 Euros, whose headquarters is situated at 183 Rue du Chevaleret - 75013 Paris and registered on the register of companies and commerce in Paris under the number B 352 236 244. Both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our general conditions of sale, having read them. These Terms and Conditions of Sale are important to you and Pixmania as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.

We recommend that you read and accept the general terms and conditions of membership of commercial partners before you make a purchase from a trader other than Pixmania.

2. Ordering

There are 4 different ways of placing an order:
- by Internet on our website: http://www.pixmania.com (24 hours a day and 7 days a week)
- by e-mail: click here
- by telephone on 08700 118 117 (calls are charged at national rate)
- by post with a printout of your order and payment method to: Pixmania, Customer Service Department, 43-47 Avenue de la Grande Armée - 75217 Cedex Paris 16 - France - fax n° +33 1 45 01 36 69. We will send you confirmation by e-mail that we have received your order.

The ordering process consists of four (4) easy steps. Once you have chosen the products you would like to buy and have confirmed your basket, you must: - log in; - choose your delivery method;
- accept the general terms and conditions of sale by ticking the box reserved to this effect on the order summary page (entitled « Order summary »);
- select your method of payment.
Once you have chosen your method of payment, you must pay for your order, which legally finalises the purchase agreement made with Pixmania.

3. Product information

Pixmania takes great care when putting information on-line with respect to the essential characteristics of our products, notably with respect to the technical descriptions emanating from our partners and suppliers and the photographs illustrating the products; this however, within the technical limits that exist and with respect for the best standards on the market.

All the accessories contained in the bundles sold by Pixmania.com are compatible brand accessories and not manufacturer’s brands. Please note that some products' instruction manuals do not come in English. If the instruction manual does not come in English, this information will be clearly featured in the technical information sheet of the specific product.
Please note that in the case where you buy a product which does not have an English instruction manual you will be able to download the English manual by clicking on a link in the “order tracking” section of the Pixmania website. We will also send you a link in the order email confirmation which directs you to the English pdf version of the instruction manual. As most products come with 2-pin plugs, adapters from European to UK plugs are supplied free of charge with your order.Please note, Epson items are delivered with French manuals & software. Both can be downloaded for free on www.epson.com

4. Prices

The prices indicated on the Site are in Pounds Sterling and in Euros and include all taxes but do not include delivery.The chosen possible delivery costs are indicated for the User during the product selection and are invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the site at the time the order was placed.

5. Availability

Please note that we will honour your order while stock is available.

In the event where one of the products ordered is not in stock, we will contact you in less than 15 days as of your order date to inform you how long it will be before we are able to deliver the product.

If there are certain products that are temporarily unavailable, we will send the available products and will pay the shipping fees for the rest of the order.We will offer you a replacement for an unavailable product, a product of equal price and quality.
If you choose to refuse, we will reimburse the unavailable product. If you wish to return it to us in the conditions outlined in article 9 (right of retraction – satisfied or reimbursed), the fees will be covered by us.

6. Delivery methods

The products bought on the Site will be delivered to mainland UK. In the event where you want your goods delivered in another country where Pixmania is present, you must purchase your order through the site that corresponds to your country (for example: for Spain, go to Pixmania Spain; for France, Pixmania France). It is the country where delivery will take place that determines the country of purchase. Your order will be delivered to the address you indicated when you placed your order. Please note that we do not deliver to the Isle of Man or the Channel Islands (Alderney, Guernsey, Jersey and Sark) .Pixmania offers 3 methods of delivery:


Express delivery
This method of delivery allows you to receive your package in 24 to 48 hours with UPS. When you place your order before 10 am, it will be handled the on same day if the product was indicated as being in stock on the site. The shipping fees for this option will depend on the articles selected.If you choose this method of delivery, payment upon delivery cannot be accepted.
Please note that, since UPS Express does not deliver on weekends, if your order is placed on a Friday it will be delivered to you on the following Tuesday, provided that your product is in stock at our warehouse. Standard deliveryThis choice of delivery will allow you to receive your package in 48 to 72 hours with Parcelforce / UPS Standard. When you place your order before 10 am, it will be handled the same day if the product was indicated as being in stock on the site. The shipping fees for this option will depend on the articles selected.

Standard delivery
Smaller items will have ROYALMAIL as a standard option with 48-72h delivery. Please note that orders with multiple items can be dispatched partly by parcelforce and partly by Royalmail.

2 man delivery
Our specialist 2-man delivery company will contact you within 48 hours of Pixmania dispatching your order to them to arrange a suitable time and date (7 days a week) to deliver your product to your home (4-hour delivery time window).
Delivery takes 4 to 6 working days to mainland England, Wales and the Scottish Lowlands including Glasgow & Edinburgh. Delivery can take up to 8 working days for the following postcode areas: TD, DG, KA, ML, G, FK, KY, AB, PH, DD, PA, IV, and Northern Irland (BT postcode). Please note thatwe do not delivery to offshore' Scottish Islands, Channel Islands nor the Isle of Man.
The item will be delivered straight to the customer’s chosen room, and unpacked and placed on a stand upon request. Any unwanted packaging will be removed and disposed of.

Pixmania does everything in its power to respect the delivery times indicated on the website. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God. In the event where you do not receive your package in the indicated time frame, an investigation will be conducted with the carrier and may take several days upon receipt of your claim (ex.7 days with Parcel Force / UPS Standard, 7 days with UPS). During this period, no reimbursement or re-delivery will take place.

Upon reception of your order, we recommend that you verify your products with the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it. Without prejudice and with respect to the applicable legal guarantees, we recommend that you address any reservations you may have pertaining to malfunctioning products on the date of delivery as quickly as possible by Post to the following address or by e-mail: Pixmania, Customer Service Department, 43-47 Avenue de la Grande Armée - 75217 Cedex Paris 16, fax (+33 1 45 01 36 69). Returned products can only be accepted for products in their original state, notably with respect to their packaging, accessories and manuals.In the event of non-conformity of the product purchased, the User will have the choice between repair and replacement of the product, except if the desired option has an associated cost that is manifestly disproportionate to the alternative. We would like to inform you that a delay of 24 hours is possible for delivery of your order. In fact, for security reasons, all orders paid by bank card are verified by PIXMANIA. Complementary information may be requested, or demanded, in order to validate your purchase. By consequence, and in trying to avoid any delay, when you place your order please enter the following:
-a professional or paid-for e-mail address
-a land line telephone number (work or home) where you can be reached at any time of the day
Furthermore, for any order above the amount established by PIXMANIA, a piece of ID as well as proof of address will be requested and should be sent via fax, Post, or e-mail. We apologise for any inconvenience this may cause; however, these measures are taken to protect our clients from possible fraud associated with bank cards.

8. Tax-free shopping

Tax-free shopping is possible for our clients residing outside of the European Union. You must, after receiving your package, send us a photocopy of your invoice and proof of address outside of the European Union. Once a voucher has been emitted by customs officers, the User is to send it accompanied by his relevant banking information and Pixmania will proceed in reimbursing the tax paid via cheque.For VAT reimbursement, there is a 3% handling charge. 9. Secure payment

Pixmania.com uses BIBIT to guarantee the security of your payments.
Pixmania has chosen to assure payment security with BIBIT by encrypting the connection when transmitting information on the network.
When you see the payment sign , you will know that your payment is secure.The name BIBIT may appear on your bank account statement.Please note that if your security department suspects fraud, we have the right to cancel the transaction for security reasons.

Pixmania offers 6 methods of payment: Credit card (Debit card, Visa or MasterCard), cash (only available in the Pick-Up store), gift certificates, bank transfer, finance option through V12 Finance and PayPal.

When you pay by credit card, your account will be debited when your order is forwarded, on condition that we have received pre-authorisation for your account. If sufficient funds are not available, your order will not be taken into account. For payments made on-line by credit card, the “Secure Socket Layer” (SSL) system of security is used, which allows for encrypting your banking information when on the network. Bank transfer payment: Your payment will be processed when your bank transfer is received. Once your payment is received we will dispatch your goods. The processing of off-line payments may take several days.

10. Right of Retraction - Satisfied or your money back

Pixmania allows you 15 days to return a product that you are not satisfied with (instead of the seven days provided for by article L 121-20 of the French Consumer Code). Your right of retraction starts from the moment your order is delivered. You can return the product within this time period, at your own expense, accompanied by your invoice and a completed and signed return goods voucher.

We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is notably necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility.

The present right of return only applies to products that are returned in their original, complete
working condition (packaging, accessories, user guide etc.). Any product that has been damaged, or is not in its original packaging, or has packaging that has been worn beyond simply opening the product, will not be refunded.

All photos stored on a digital support (memory card, hard drive etc.) and sent back to Pixmania by the User will not be kept. The deadlines mentioned above are effective as of the date of reception of the order. You can fill in your returns coupon in your Pix & I space.

For reimbursements:


- If the product is returned within 7 working days
of its delivery, the User will be reimbursed by bank transfer if payment was made by bank card, or by cheque in other cases. If the User paid by bank card (via a bank card reader) at a Pick-Up Store, reimbursement will be made by cheque.

If tests need to be carried out on the product, in the framework of the right of retraction, Pixmania will do its best to reimburse the User as quickly as possible. This time period will depend on the nature of the technical tests performed by the After-Sales Service of your product’s manufacturer, for a maximum period of 3 weeks.

- If the product is returned between the 8th and 15th day after purchase: you will be refunded in the form of gift vouchers

Only Kitchen and Home Appliances :
Cancellations:

You can cancel your purchase at any time up to 7 working days following the day you receive the goods. In this case please call us on 08700 118 117 (open Monday - Friday 9 am - 5 pm) with your order number (example CCL065214521) or send an e-mail to currys_uk@pixmania.com with the serial number of the product to be returned. We will then arrange to collect the goods from you.

Your product must be complete and in ‘as new’ condition (i.e. if you have opened the box to examine the product you must have done so without damaging or marking the product or packaging). It must not have been used or installed. It should be returned with the original box, packing and accessories you received with it. By following the steps above you will receive a full refund for the price of the product and any delivery charges paid. However, you must pay the following charges if the goods are collected from you:

If you return two or more product types together, only the higher charge will apply. The collection charge will be debited from your account at the same time as your purchase is refunded and will be shown separately on your receipt.

 

11. Returns

All products except Kitchen and Home Appliances:

For any returned package, please go to your PIX&Me space and follow the return policy instructions.

Please note that shipping fees are the client’s responsibility, except if the product does not conform to the description of said product (the client is responsible for any damage done during the shipping of the returned goods).

For the period covered under warranty, the client must return the product to PIXMANIA’S After-Sales Service. No package will be accepted at the head office of Fotovista / Pixmania.

12. Guarantees and After-Sales Service

All products except Kitchen and Home Appliances:
All of the products we sell benefit from:
- The legal guarantee of conformity;
- The legal guarantee from hidden flaws;
- The manufacturer’s guarantee for a period defined by the product purchased and the brand. Shipping fees of the products are the customer’s responsibility.

However, if the product does not conform to the product description, shipping fees will be reimbursed to the customer.

For any returned package, please go to your PIX&Me space and follow the return policy instructions.
Pixmania will handle possible repairs with the manufacturers.
Whatever the problem is with your product, you must attach, with the defective product, a copy of your invoice, the guarantee (in the box) and the return goods voucher.
Please note that legal guarantees do not apply to repairs for damage caused by external origin (for example, accidents, shocks, fluctuation of electricity etc.) or by the user’s faulty usage of the product such as a non-conforming installation or using it for commercial purposes or using said product with incorrect peripherals, accessories or consumables. The manufacturer’s guarantees sold by PIXMANIA do not cover: -replacement of consumables (batteries, light bulbs, fuses, recording heads or lasers etc.),
-the abnormal use or non-conforming usage of products. We ask that you consult the user’s manual provided with the products
-malfunctioning due to accessories (power cables etc.)
-damage from external sources (shocks, accidents, electricity current fluctuations etc.).

In all cases, PIXMANIA will not be held responsible in the event that the manufacturer refuses to honour the warranty due to, but not limited to, any of the above noted reasons.

In the event where the manufacturer will not provide service under warranty, an estimate of the cost of the repair will be given to the customer. Administrative fees will be requested if payment for the estimate is not made. If the User agrees to the estimate, a cheque will be issued to FOTOVISTA and will correspond to the estimate amount, and ought to be sent to us.
Faulty goods Only Kitchen and Home Appliances:
If there is a fault with your product within 12 months of delivery (or other defects with your order), we will normally offer a prompt repair, exchange. You will always have the option of an exchange or refund if the fault occurs within 28 days of delivery. To qualify for a refund or exchange the product must be:- In “as new” condition, and- Complete, with any accessories and free gifts offered with it (and, if possible, the original box and packaging). This guarantee does not cover faults caused by accident, neglect, misuse or normal wear and tear. Any refund due to a fault or other defect will include a refund of the applicable delivery charge. We will also pay for our costs of collecting goods for replacement or refund. Replacement goods are sent by standard delivery only.

13. Responsibility

Pixmania will not be held liable for poor use and its consequences on the products purchased from our Site. Although our products have performance that is compatible with professional usage, Pixmania does not sell products for professional usage.

14. Pixmania Service

Without prejudice towards the applicable legal guarantees, Pixmania also offers other services such as the Zen Engagement contract, warranty extensions and promotional codes.

The Zen Engagement contract

Conditions applicable from 08/12/2006


Article 1 : WHAT IS THE ZEN ENGAGEMENT?

A contract that allows you to:

  • be refunded for the first 12 months after your purchase in the form of credit in your Pix Piggy bank
  • benefit from Price Matching
  • Trade-in of your product so that you can purchase something new
  • Up to 25% off a selection of accessories for your product
  • An information service to help you with any problems
  • If you opt for the Zen Engagement when paying for your order, you can get the VIPix card for £7 instead of £14!

- Article 2 : APPLICABLE CONDITIONS
The Zen Engagement must be taken out at the same time as the product is purchased.
The Zen Engagement is limited to one single use. If your product breaks down, you have 12 months from the date of purchase to get a refund in the form of credit in your Pix Piggy bank. The product must be returned to Pixmania so that the cause of the breakdown can be determined by technical examination. A refund will be issued once the technical inspection has been completed in the form of credit in your Pix Piggy bank. The Pix Piggy bank can be used for all Pixmania products. The Pix Piggy bank can be used for more than one order. The Pix Piggy bank is equal to the value of the product excluding shipping and guarantee. If your order is greater than the value of the Pix Piggy bank, you can make up the difference by a payment method of your choice.

Applicable Conditions for Price Matching:
If you find your product for less on another UK website within 7 days of purchase, PIXMANIA will refund you the difference (same new product, including the same accessories and equivalent warranty)! Price Matching only applies to products in the following ranges: CAMERA, CAMCORDER, TV VIDEO, I.T. PRODUCTS, SOUND and TELEPHONY (accessories and consumables not included). The product price is the price displayed (VAT inc.) excluding discounts such as promotional codes, gift certificates, and any other promotional offers (stock liquidation or sales). This offer is limited for each product purchased on www.Pixmania.com to one refund per household. Products from websites based on bidding systems or small ads placed by individuals and/or products delivered outside of the UK are not included.If you find your product for less on another UK website within 7 days of purchase, PIXMANIA will refund you the difference (same new product, including the same accessories and equivalent warranty)! To obtain the refund, you just need to send us a copy of your invoice, a print-out of the page on the website with the same product as you purchased from Pixmania (listed at a lower price) and your bank details (IBAN). Once the details have been confirmed, we will refund you the difference between the product you purchased on www.pixmania.com and the price you have found on another site in the UK according to the above conditions, by bank transfer.
Applicable conditions for trade-in of your product:
You have bought a new product with the Zen Engagement. You can trade-in your product for a new one. Use the trade-in form in your Pix&Me space. Once your request has been confirmed, you will receive a return authorisation e-mail. Please send us back your product in its original, complete packaging (with instructions and original accessories) by post: postage not covered. Once the technical testing has been carried out, you will receive credit in your Pix Piggy bank, allowing you to purchase a replacement item. The trade-in does not apply to electrical appliances, accessories, or consumables. A product that is scratched or shows signs of impacts will not be traded-in and will be returned by Pixmania to the customer.

 

- Article 3 : THE PRICE
The service costs 6.95% of the price of the selected product including V.A.T. (excluding delivery costs) and applies to all products (not including accessories, cables, batteries, memory cards etc.) with a value of over £1.50 including VAT.

- Article 4 : CONDITIONS FOR REIMBURSEMENT
The product must undergo a technical inspection to identify the nature of the breakdown, to confirm that this does fall within the terms of the manufacturer’s warranty and that the product is returned in its original packaging with all included accessories (e.g. CD-Rom, cables, user manual etc.).
If the problem is not covered by the warranty, an estimate for repairs will be issued by the manufacturer. A service charge shall be issued if the estimate is refused. If the estimate is accepted the amount should be paid by cheque payable to FOTOVISTA.

- Article 5 : WHAT TO DO IF YOUR PRODUCT BREAKS DOWN
If your product breaks down you should contact the Customer Care Service Monday to Friday 9am-5pm:

Products must be returned in their original packaging with a Returns Coupon with an insured delivery service (we recommend Royal Mail insured).

- Article 6 : LIST OF EXCLUSIONS IN THE APPLICATION OF THE ZEN ENGAGEMENT
The Zen Engagement cannot be used for:
- Goods that cannot benefit from this contract
- Damage, malfunctioning or defaults of external origin
- Breakdowns resulting from modification of the manufacturer’s original characteristics of the product
- Breakdowns caused by non-conforming use of peripherals not recommended by the manufacturer
- Adjustments accessible to the User without taking apart the product
- Fees for service, adjustments, cleaning and non-consecutive attempts for damage under warranty
- The non-respect of instructions by the manufacturer and usage for professional or commercial purposes
- Repairs and damage done to the product after repairs to the product by non-authorised personnel
- Chance or provisional repairs and the possible resulting damages
- Damage due to corrosion, a poor connection or power supply problems
- For power supply problems, we refer not to an internal problem with the products, but external to it. If, for example, the product is connected to a faulty connection, the warranty does not apply.

"Conditions applicable before 08/12/2006"

- Article 1 : WHAT IS THE ZEN ENGAGEMENT?
This service allows you to recover the full value of your product, in the form of an electronic voucher, should your product break down in the twelve months following the purchase from Pixmania.

In addition to this, if you purchase a Zen Engagement for more than £14 you get the VIPix card as a free gift.

- Article 2 : APPLICABLE CONDITIONS
The Zen Engagement must be taken out at the same time as the product is purchased.
The Zen Engagement can only be used once.
The service is valid for 12 months following the purchase of your product.

The reimbursement, in the form of an electronic voucher valid for 12 months, shall be carried out within a few days of a positive outcome of the technical inspection (PIXmania will send you an electronic voucher by email).The reimbursement will be made a few days later in the form of a gift voucher valid for 12 months (PIXmania will send you the voucher in your name and to the billing address except if there has been a change of address).
The voucher can be used to purchase any product on the PIXmania catalogue.
The value of the voucher shall be equivalent to the value of the product excluding delivery charges and the cost of the Zen Engagement or any extended warranties.
If the value of the replacement order is higher than the value of the voucher you can make up the difference by a payment method of your choice.

- Article 3 : THE PRICE
The service costs 5.9% of the price of the selected product including V.A.T. (excluding delivery costs) and applies to all products (not including accessories, cables, batteries, memory cards etc.) with a value of over £1.50 including VAT.

- Article 4 : CONDITIONS FOR REIMBURSEMENT

- For power supply problems, we refer not to an internal problem with the products, but external to it. If, for example, the product is connected to a faulty connection, the warranty does not apply.

Extended Warranties
Pixmania offers a choice of two types of extended warranty:
The 3 year extended warranty extends the warranty by one year, providing a total warranty of 3 years.
The 5 year warranty extends the warranty by three years, providing a total warranty of 5 years.
The warranties are valid in all the European countries covered by the PIXMANIA network.
The warranties are offered to you during the ordering process. Please note that the price of the warranty is directly dependent on the value of the product.
The extended warranties operate according to the same conditions as the manufacturer’s warranty and cover parts and labour. If the manufacturer declares that the cost of repairs would be higher than the value of the product, the product shall be replaced by an identical product or a product that is considered to be an equivalent.

The following are excluded from the warranty:
- All problems and defects arising due to alterations made to materials by the owner without the express written consent of the manufacturer.
- The cost of replacing parts or servicing or repairs due to ageing and normal wear and tear.
- Shipping costs directly or indirectly related to the warranty.
- Defects and damage resulting from misuse including:
